AGREEMENT FOR SERVICES EXCLUSION
What is not covered??
1.These plans do not cover the following components or specific conditions-
1.1. Loss arising after 12 months from the date of purchase.
1.2. If the plan is bought on a date which is post the date of purchase of the Covered Product.
1.3. Loss arising due to unlawful act including Terrorist Activity, War, Nuclear Explosion, Radioactive Contamination, Chemical, Biochemical, Biological, Electromagnetic, Cyber Attack etc.
1.4. Retailer Invoice or the Covered Product does not bear the IMEI/Serial Number.
1.5. Loss covered by supplier, dealer or factory warranty.
1.6. If the Covered Product is bought outside India or via a channel or retailer that is not an officially channel mandated or recognized by the Brand.
1.7. Any loss of data or software installed in the product.
1.8. Any loss arising outside the territorial limits of India.
1.9. Covered Product does not have a minimum of 12 months manufacturer’s warranty that is valid in India.
1.10. Any loss due to SIM card and any ancillary product etc. even if the product results in complete stoppage of functioning.
1.11. Physical or liquid damage occurring outside of the Coverage Term.
1.12. If your device gets damage due to God’s act. (flood, cyclone, thunder etc.)
1.13. Any loss or damage to accessories and panels even if forming a part of standard pack or to any complimentary or ancillary product/s made available under any promotional scheme.
1.14. Loss or damage caused by mechanical or electrical derangement/ breakdown of any article unless caused by accidental external means or specifically declared and accepted by us and expressly stated in the policy schedule.
1.15. The cover shall be voidable in the event of misrepresentation, misdescription or non-disclosure of any material particular to the insured device.
1.16. Loss or damage caused to the Insured Device due incorrect storage, installation, or incorrect setup by the insured.
1.16. Any type of self-repair or attempted self-repair of the Insured Device by the insured.
1.17. Device unboxing, or the device activation date is prior to the device invoice date, in such scenarios, the plan stands void.
1.18. Any damages to the Registered Device prior to the Plan activation.
1.19. Any damages reported within 7 days of activation of the Plan.
2. Any damage to the Registered Device:-
2.1. Due to Intentional act or willful neglect.
2.2. Due to any experiments or tests and/or alterations resulting to any abnormal conditions of the Registered Device .
2.3. Under mysterious circumstances including lost or stolen.
2.4. Any physical or liquid damage that has occurred prior to the commencement of the plan.
2.5. Any loss due to hire or loan of the covered product to a third party.
2.6. Loss or theft or burglary of the device arising out of any reason whatsoever.
2.7. Consequential loss of any kind or wear & tear, manufacturing defects etc.
2.8. Loss caused by incorrect storage, poor care and maintenance, careless use, gross negligence, incorrect installation and incorrect set-up.
2.9. If the brand to which the Covered Product belongs does not have minimum 1 authorized Service Center any where in India at the time of filing a Service Request.
2.10. Any loss, which is cosmetic in nature and does not result in complete stoppage of/or functioning of product.
2.11. Damage to device while participating in any kind of sports activity including swimming and gym.
2.12. Damage caused by any process of cleaning, dyeing, or bleaching, restoring, servicing, preventative maintenance, repairing or renovation or deterioration arising from wear and tear, moth, vermin, insects or mildew or any other gradually operating cause.
2.13. Loss of or damage to the device that is registered in the name of a corporate entity and is not used by a bonafide user.
2.14. Device repaired/Replaced without the formal approval from Insurance company.
2.15. Device Identity: IMEI or serial number of the device should be clearly visible in the submitted salvage, claim shall be rejected in case identity of device is not proven.
2.16. Use of the insured device for commercial activity by giving the insured device to other company on hire, rental, loan, or the device ownership transferred to the third party.

2.18. If the Plan has been purchased more than 30 days or 365 days as the case may be from the purchase of the registered device.
2.19. Theft or loss of the smartphone.
2.20. Due to serial number that has been altered, defaced or removed, or has been modified to alter its functionality or capability without the written permission of garanty.in.
2.21. If damaged by fire, electric shock etc.
3. Damage caused by:-
3.1. Service (including upgrades and expansions) performed by anyone who is not an Authorized Service Centre.
3.2. Consequential loss of any kind or description including wear & tear, manufacturing defects Cosmetic damage to the Registered Device including but not limited to scratches, dents and broken plastic on ports.
3.3. Registered Device that has been stolen.
3.4. Loss or damage covered by supplier, dealer or Manufacturer’s Warranty.
3.5. Third-party products or their effects on or interactions with the Registered Device or the software.
3.6. A product/accessory that is not the Registered Device.
3.7. Operating the Registered Device outside the permitted or intended uses described by manufacturer.
4. Special Exclusions:-
Garanty.in shall not be liable in respect of loss or damage to Registered Device relating to or caused due to the following:-
4.1. Penalties for delay or detention or in connection with guarantees of performance or efficiency.
4.2. Loss or damage due to mechanical or electrical break down or derangement, unless such loss is accidental damage, and which is not covered within the Manufacturer’s Warranty.
5.Garanty.in shall not be liable if:-
5.1. If the Plan has been purchased more than 30 days or 365 days as the case may be from the purchase of the registered device. Due to the inability of the Customer to submit either of the processing documents or supporting documents required for processing the request.
5.2. The user is found to be involved in any way in fraudulent or illegal activity of any kind whatsoever related to this Plan or Registered Device.
5.3. In any action, suit or other proceeding where the Garanty.in or underwriting garanty.in alleges that by reason of the provisions of the exceptions or exclusions above, any loss, destruction or damage is not included under this Plan, the burden of proving that such loss, destruction or damage is included, shall be upon the Customer.
6.Maximum Liability:-
The liability under Garanty.in shall not exceed in aggregate the Coverage Amount, the basis of indemnity shall be the cost of replacement as stated below:-.
6.1. Partial Loss: Maximum liability for the Covered Product shall be the sum of 2 times of repair cost or invoice value of device. If the repair cost is above 70% to 80% of device value, the service request shall be considered as Beyond Economical Repair and shall be settled on a Total Loss basis.
6.2. Total Loss: Maximum liability for the Covered Product shall be the Coverage Amount/invoice value subject to Depreciation, depending on the age of the Covered Product from the Coverage Start Date till the Date of filing the service request
6.3. If the repair amount is greater than the covered value/ invoice value You will retain the option to bear the difference amount to get the Covered Product repaired.
6.4.Maximum of 2 service requests shall be addressed during the Coverage Term.
7.1. Depreciation (In case of Total loss)

91 to 180 days | 30% of Purchase Price |
181 to 270 days | 45% of Purchase Price |
270 to 365 days | 55% of Purchase Price |
7.2. If your device is not repairable or the repair cost is greater than the current market price, you would be given a Replacement Device OR Gift Voucher at the discretion of Garanty.in.
